Time Limits for Processing Applications of Enterprises with Foreign/Overseas Investment

1.Proposals for Chinese-Foreign Equity Joint Ventures and Chinese-Foreign Contractual Joint Ventures shall be processed within 5 working days from date of receipt by the approving authority of complete application documents.

2.For feasibility studies of Chinese-Foreign Equity Joint Ventures,the part concerning the necessary external matching conditions shall be processed,in the case of renovation projects involving aged enterprises on original sites,within 10 working days,or,in the case of projects on new sites,in accordance with the relevant stipulations of the Municipal Governments.The feasibility study as a whole shall be processed eventually within 5 working days from date of receipt by the approving authority of complete application documents.

3.Contracts and Articles of Association of Chinese-Foreign Equity Joint Ventures and Chinese-Foreign Contractual Joint Ventures,Application and Articles of Aassociation of ForeignCapital Enterprises shall be processed within 10 days from date of receipt by the approving authority of complete application documents.

4.The Certificate of Approval for Chinese-Foreign Equity Joint Ventures and Chinese-Foreign Contractual joint Ventures as well as Foreign-Capital Enterprises shall be processed within 2 days from date of receipt of complete documents of approval.

5.Business Licences for Chinese-Foreign Equity Joint Ventures,Chinese-Foreign Contractual Joint Ventures and Foreign-Capital Enterprises shall be processed within 7 days from date of receipt of complete documents of approval. Failing to give an official written reply within the above mentioned time limits shall be deemed as giving approval.The reply shall state either approval or disapproval.When disapproved,any further application shall be processed again in accordance with the time-limits herein stated.
